Terms of Use and End User License Agreement
Effective date: October 1, 2026
1. Agreement
These Terms of Use and End User License Agreement ("Terms") are between you and New Mind Hypnotherapy LLC ("New Mind," "we," "us"). They govern your use of the New Mind mobile app (the "App"), our client portal, our online course and our websites (together, the "Services"). By downloading, accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
2. Eligibility
You must be at least 18 years old, or use the Services with the consent and supervision of a parent or guardian who agrees to these Terms for you.
3. Important health notice
The Services provide education, self-hypnosis and personal-growth tools. They are not medical or psychological care, and New Mind does not diagnose, treat or cure any medical or mental health condition. The Services do not replace care from a licensed professional. Do not stop or change any medication or treatment without talking to your provider. If you have a history of seizures, psychosis or a serious mental health condition, consult your provider before using hypnosis audio.
Never listen to hypnosis or relaxation audio while driving, operating machinery or doing anything that requires your full attention.
If you are in crisis or thinking about harming yourself, call or text 988 (Suicide & Crisis Lifeline) or call 911. The Services are not monitored for emergencies.
Results vary from person to person, and we do not guarantee any specific outcome.
4. Your account
You agree to give accurate information and keep your login details confidential. Your account is for you alone: do not share your login or course access with anyone else. You are responsible for activity under your account. Tell us right away at support@newmindhypnotherapy.com if you suspect unauthorized use.
5. License to use the App and content
Subject to these Terms, New Mind grants you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, and to access the course content for your own personal, non-commercial use. You may not:
copy, record, download (except where we provide a download), share, sell, rent or distribute any content;
modify, reverse engineer, decompile or create derivative works of the App or content;
scrape, data-mine or use automated tools on the Services;
use the Services to build a competing product; or
bypass any security or access controls, including the content release schedule.
6. Course access
Your course access is governed by the enrollment terms you accepted when you enrolled. Enrollment happens outside the App; the App does not sell anything. Lessons open on a set schedule. We may update, improve, add or remove content over time. Refunds, if any, follow your enrollment terms.
7. Community standards and zero tolerance
The Services may let you send messages, post comments, upload files or take part in groups ("User Content"). You keep ownership of your User Content and give New Mind a license to host, store and display it as needed to operate the Services.
New Mind has zero tolerance for objectionable content and abusive users. You may not post or send content, or behave in a way, that is:
harassing, bullying, threatening, hateful or discriminatory;
sexually explicit, obscene or violent;
defamatory, deceptive or impersonating another person;
sharing another person's private information without consent;
spam, advertising or solicitation; or
unlawful or encouraging illegal activity or self-harm.
We may remove any content and suspend or permanently terminate any user who violates these standards, without notice. To report objectionable content or an abusive user, email support@newmindhypnotherapy.com with the subject "Report." We review reports within 24 hours and will remove offending content and remove the user who posted it when warranted.
8. Communications
You agree to receive service messages about your account, lessons and appointments by email, text message and push notification. Marketing messages are sent only with your consent, and you can opt out at any time as described in our Privacy Policy.
9. Intellectual property
The App, course videos, audio, workbooks, text, graphics and the New Mind name and logo are owned by New Mind or its licensors and are protected by copyright and trademark law. Except for the license in section 5, no rights are granted to you.
10. Third-party services
The Services rely on third-party providers, including HighLevel/LeadConnector (app and portal platform), payment processors and video tools. Your use of those services may also be subject to their terms. We are not responsible for third-party services.
11. App store terms
If you downloaded the App from the Apple App Store:
These Terms are between you and New Mind only, not Apple Inc. ("Apple"). New Mind, not Apple, is solely responsible for the App and its content.
Your license is limited to use on Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the App may be accessed by other accounts associated with you through Family Sharing or volume purchasing.
New Mind is solely responsible for maintenance and support of the App. Apple has no obligation to provide any maintenance or support.
If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, for the App. To the maximum extent permitted by law, Apple has no other warranty obligation regarding the App.
New Mind, not Apple, is responsible for addressing any claims by you or a third party relating to the App, including product liability claims, claims that the App fails to meet legal or regulatory requirements, and claims under consumer protection, privacy or similar laws.
If a third party claims the App or your use of it infringes their intellectual property rights, New Mind, not Apple, is solely responsible for the investigation, defense, settlement and discharge of that claim.
You represent that you are not located in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. government list of prohibited or restricted parties.
You must comply with any applicable third-party terms when using the App, such as your wireless data service agreement.
Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple has the right to enforce them against you as a third-party beneficiary.
If you downloaded the App from Google Play, the Google Play Terms of Service also apply, and Google is not responsible for the App.

12. Disclaimers
The Services are provided "as is" and "as available." To the fullest extent permitted by law, New Mind disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise the Services will be uninterrupted or without errors.
13. Limitation of liability
To the fullest extent permitted by law, New Mind will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, profits or goodwill. Our total liability for any claim relating to the Services is limited to the greater of the amount you spent with us in the 12 months before the claim or $100.
14. Indemnity
You agree to indemnify and hold New Mind harmless from claims, damages and costs (including reasonable attorneys' fees) arising from your User Content, your misuse of the Services or your violation of these Terms.
15. Termination
You may stop using the Services and ask us to delete your account at any time. We may suspend or end your access if you violate these Terms. Sections 3, 5 (restrictions), 7, 9 and 12 through 18 survive termination.
16. Governing law and disputes
These Terms are governed by the laws of the State of Utah. Before filing any claim, you agree to contact us and try to resolve it informally for 30 days. Any dispute that is not resolved will be heard only in the state or federal courts located in Utah County, Utah.
17. Changes
We may update these Terms. We will post the new version here with a new effective date and, for material changes, notify you in the App or by email. Continued use after changes take effect means you accept them.
18. General and contact
These Terms, our Privacy Policy and your enrollment terms are the entire agreement between you and New Mind about the Services. If any part is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a business transfer.
